JUDGMENT / ORDER

P r a y e r : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the second respondent to consider the Petitioner's representat5ion dated 29.6.2017 to measure the Petitioner's land in S.No. 37/8A, measuring an extent of 8.50 ares situated at Keelanettur Village Group, Ilayangudi Taluk, Sivagangai District.

2.Mr.C.M.Mari Chelliah Prabhu, learned Additional Government Pleader takes notice for the respondents. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.The Petitioner would submit that he is the joint owner of the land comprised in S.No.37/8A, measuring an extent of 8.50 ares situated at Keelanettur Village Group, Ilayangudi Taluk, Sivagangai District and that being an ancestral property, by way of partition, the Petitioner has inherited the same and the Petitioner and his family members are in possession and enjoyment of the said property. Meanwhile, he would further in his representation submitted on 29.6.2017, states that persons who are holding lands in the adjacent area namely, one Sannasi, son of Chandran, sivasami and Silambarasan are interrupting their possession and they are trying to encroach upon the said land. Hence to survey the said land and to fix the boundaries, the Petitioner submitted a representation on 29.6.2017 to the respondents, so that the authorities concerned can measure the land and fix the four boundaries in order to prevent any encroachment.
4.Even though this Court is not inclined to consider the above request of the http://www.judis.nic.in 3 Petitioner since it is purely a civil dispute, based on the submission made by the learned counsel for the Petitioner that there is no encroachment but the above said persons are only trying to encroach upon the Petitioner's land, the respondent concerned is directed to consider the representation of the Petitioner, dated 29.6.2017 for measuring the property in question and to fix the four boundaries as per law and pass appropriate orders after giving notice and ample opportunity of hearing to the Petitioner and other interested parties, if any, within a period of four months from the date of receipt of a copy of this order.
5.With the above direction, the Writ Petition stands disposed of. No costs.
