This appeal is preferred against the order rejecting the plaint in O.S.No.15 of 2006 on the file of the Sub Court, Ernakulam. The matter was referred for mediation as per order dated 15th July, 2014 and it is reported that the matter is settled at the mediation. The settlement arrived at in the mediation is part of the records.
2. In the light of the settlement arrived at between the parties at the mediation, the impugned judgment is set aside and the suit, O.S.No.15 of 2006 on the file of the Sub Court, Ernakulam is disposed of in terms of the settlement. A copy of the settlement shall be appended to this judgment and the original shall be preserved.
3. In view of the provisions contained in section 69A of the Kerala Court Fees and Suits Valuation Act, 1959, the appellant is R.F.A. No.504 of 2008 -:2:-
permitted to move the court below for refund of the court fee paid at the time of institution of the suit.
