Petitioner has filed Ext.P2 appeal, Ext.P3 stay petition and Ext.P4 application for early hearing. Ext.P2 appeal is filed against Ext.P1 order passed by the assessing authority. Apprehending recovery steps pursuant to Ext.P1 order, petitioner has approached this Court seeking for stay of further proceedings pursuant to Ext.P1.
2. Heard learned Government Pleader.
3. Having regard to the fact that an appeal is pending before the appellate authority, it is for the said authority to pass appropriate orders.
4. Accordingly, this writ petition is disposed of as under:
i) The appellate authority shall consider Ext.P3 stay petition and pass appropriate orders within a period of one month from the date of receipt of a copy of this judgment.
ii) Until such time, any proceedings for recovery of amount covered by Ext.P1 order shall be kept in abeyance.
