HON’BLE Dr. JUSTICE K.G.SHANKAR Criminal Petition No.6287 of 2014 Order:
The petitioners allegedly committed the offences under Section 324 read with Section 34 IPC and under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (the SCs/STs Act, for short). The case is at the investigation stage. The petitioners seek for the quashment of the First Information Report (FIR) in Crime No.63 of 2014 on the file of Wanaparthy Rural Police Station, Mahabubnagar.
2. In view of the nature of seriousness of the allegations, it would be appropriate to permit the Police to proceed with the investigation. However, where it is contended by the petitioners that the case was foisted against them on account of political rivalry, it would be appropriate to restrain the Police from arresting the petitioners during the pendency of investigation.
3. Accordingly, this criminal petition is disposed of directing the Police to proceed with the investigation of the case in Crime No.63 of 2014 on the file of Wanaparthy Rural Police Station, Mahabubnagar but not to arrest the petitioners during the pendency of investigation. The miscellaneous petitions, if any, pending in this petition shall stand closed.
