… Respondents THE HON’BLE SHRI JUSTICE SANJAY KUMAR WRIT PETITION NO.24616 OF 2004 O R D E R This writ petition was filed challenging the show cause notice dated 19.07.2004 issued by the Mandal Revenue Officer, Chillakur Mandal, Nellore District. The said notice was issued under the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977.
By order dated 19.01.2005, this Court granted stay of dispossession of the petitioner from the lands in question. However, there was no stay of further proceedings pursuant to the show cause notice. While so, the Mandal Revenue Officer, Chillakur Mandal, filed a counter-affidavit, wherein he stated that after considering the explanation dated 02.08.2004 of the petitioner in response to the show cause notice dated 19.07.2004, he passed resumption orders dated 26.09.2004. No reply-affidavit was filed by the petitioner disputing these facts. Further, no amendment was sought in the writ petition prayer. Thus, the writ petition, as framed, is merely directed against a show cause notice which has worked itself out in the light of the final resumption order passed on 26.09.2004. The matter therefore does not survive.
The writ petition is accordingly dismissed. Interim stay granted on 19.01.2005 shall stand vacated. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
