ORDER:
Heard the learned Counsel for the petitioner and learned Standing Counsel for the third respondent.
The case of the petitioner is that in the year 1975 Employees Residence Colony was formed at Gunipudi in Bheemavaram of West Godavari District and it is spread over about Ac.3.00 cents of land and about 200 families are living in the buildings constructed in the said colony. There are five roads in the colony and the third respondent laid cement roads and provided all civic and basic amenities. In between the said roads, there is main road called FCI road and one Menti Krishna Prasad prepared a layout in Ac.2.00 cents of land in R.S.No. 372 (P) at Gunupudi and converted it into house site plots. However, as the said Krishna Prasad did not connect the roads of the layout with the roads of the employees colony, the petitioner and others submitted representations to the second and third respondents requesting not to accept the layout without connecting the roads or modifying the layout so as to connect the roads. The third respondent issued proceedings in Roc.No. 1101/06/G1 dated 06.04.2006 stating that there is no feasibility to connect the roads of Employees Colony with the roads in layout LP.No. 8/2006/R on the ground that the roads in Employees Residence Colony are 10 to 15 feet width, whereas roads in the said layout are 40 feet width. Aggrieved by the same, the petitioner preferred an appeal to the first and second respondents on 25.04.2006. As no action is initiated to connect the roads, the present Writ petition is filed.
None of the respondents filed counter even after four years.
In the circumstances, this Writ Petition is disposed of directing the first and second respondents to consider the representation/appeal dated 25.04.2006 filed by the petitioner and consequential notice issued by their counsel on 28.07.2009 for connection of roads from Employees Colony, Gunupudi to FCI road, Bhimavaram through layout LP No.8/2006/R of Gunupudi, Bhimavaram as per the provisions of the Andhra Pradesh Municipalities Act, 1965 and Andhra Pradesh (Andhra Area) Town Planning Act, 1920 within a period of three months from the date of receipt of a copy of this order.
As a sequel thereto, miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No costs.
