Shivkumar, Advocate for R2) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to direct the R2 to consider the representations dated 13.06.2016 vide Annexure-G, 17.06.2016 vide Annexure-H, 14.07.2016 vide Annexure-J, 29.08.2016 vide Annexure-K, 14.09.2016 vide Annexure-L, 17.06.2016 vide Annexure-M, 14.07.2016 vide Annexure-N, 29.08.2016 vide Annexure-O and 10.02.2017 vide Annexure-P respectively for reimbursement of the bill amount of `15,48,800/- along with the interest at the rate of 12% P.A and pay the said amount of `15,48,800/- with interest if there are no legal hurdles or in the alternatively direct the R2 to forthwith honour the bills submitted by the petitioner by reimbursing the amount of `15,48,800/- along with interest at the rate of 12% P.A for having completed the work assigned to the petitioner by R2.
This Petition coming on for Orders, this day, the Court made the following:-
ORDER Sri. Thyagaraja S., learned counsel for Sri. Padmanabha R., learned counsel for the petitioner.
Sri. Y.D. Harsha, learned AGA for respondent No.1.
Sri. V.B. Shivkumar, learned counsel for respondent No.2.
Petition is admitted for hearing. With the consent of the parties, it is heard finally.
2. In this petition, petitioner interalia seeks a writ of mandamus to consider representations as referred to in the writ petition for reimbursement of the amount.
3. When the matter was taken up today, learned counsel for the petitioner submits that petition be disposed of with a direction to respondent No.2 to consider and decide the representations of the petitioner in a fixed time limit.
4. On the other hand, learned counsel for respondent No.2 submits that suitable action on the representations shall be taken in accordance with law.
5. In view of the submissions made and the facts of the case, writ petition is disposed of with a direction to respondent No.2 to consider and decide the representations submitted by the petitioner within a period of six weeks from the date of receipt of certified copy of the order passed today by a speaking order.
Accordingly, petition is disposed of.
