Petitioner has approached this Court seeking assignment of puramboke land in Re-survey No. 11/1 in Oorakam Village of Thiroorangadi Taluk in Malappuram District. According to the petitioner, the entire surrounding property belongs to the petitioner and there is no necessity for the Government to hold the said land. The land in question is required for the beneficial enjoyment of the petitioner. 2. It is not in dispute that the petitioner is having an extent of 3 acres of land in the said area and the petitioner is not entitled for any assignment of land even for beneficial enjoyment of the property. Under these circumstances, the petitioner's request cannot be considered. Therefore, there is justification on the part of the District Collector to have refused assignment in terms of Ext. P3.
Hence, there is no merit in the writ petition and accordingly the same is dismissed.
