On 18.04.2019, the following order was passed:
"Ten days and no more time is granted to the learned counsel for the petitioner Sri Mohan Srivastava to file an appropriate application to bring on record the successor partner/Managing partner representing the petitioner, as the Managing partner Shiv Shankar Tiwari, through whom the petitioner is represented is reported to be no more.
List this petition on 29.04.2019."
The petitioner who is represented through managing partner Shiv Shanker Tiwari, who is dead and the successor, managing partner on whose behalf, time was sought on 18.04.2019 has not come forward and sought substitution despite this Court's order. Thus, no useful purpose would be served by permitting the petitioner to pursue this petition any more.
Accordingly, this petition is dismissed for non prosecution. Interim order dated 13.08.2009 is hereby vacated.
Let this order be communicated to the Prescribed Authority, Payment of Wages Act, Mirzapur by the office within a week.
