The petitioner has filed the present petition inter-alia with the following prayers:-
1. Issue an appropriate order to the Civil Judge (J.D.) Pachimi Ballia to expedite disposal of impleadment application (under order 1 Rule 10 CPC) dated 18.01.2020 in Original Suit No.163/2019 (Anurag Vs. Virendra and others) pending before the Learned Court of Civil Judge (J.D.) Pachimi Ballia, District Ballia.
2. Issue an approprate order and time bound direction to the learned Civil Judge (J.D.) Pachimi Ballia, District Ballia to dispose of the Original Suit No.163/2019 (Anurag Vs. Virendra and others) within a month on the basis of day to day hearing in public interest at large."
Today when the matter is taken up, a withdrawal application supported by an affidavit of one Khalid Fazal, Executive Engineer Electricity Transmission Division, Ballia has been filed with the prayer that the petitioner wants to withdraw the present petition as not press with liberty to file fresh petition.
The prayer made in the withdrawal application is accepted.
Accordingly, the present petition is dismissed as not pressed with liberty as prayed.
