JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr. Navin Pahwa, learned counsel for the petitioners and Mr. Rakesh R. Patel, learned Assistant Government Pleader, appearing for the respondents. Mr. Pahwa has vehemently urged that elections of Shri Gondal Taluka Kharid Vechan Sangh Limited was scheduled to be held on 15/10/2012, every process was completed and only voting was to be done on 15/10/2012 but the respondents have postponed the elections by order dated 13/10/2012 in view of the ensuing Assembly Elections. Mr. Pahwa contended that on 03/10/2012, Moral Code of Conduct was enforced whereas, list of candidates was finalized on 05/10/2012. Mr. Pahwa has urged that the elections of the specified society could not be postponed as Moral Code of Conduct is not applicable to such societies.
2. Be that as it may. We are not entering into this question in view of the fact that polling was to be held on 15/10/2012, which has passed long back, we are in November 2012. The Assembly Elections are scheduled to held in December 2012 and final results are to be declared on 20/10/2012. Therefore, the polling of the specified society could be held after the election results of Assembly, as has been declared.
3. In this view of the matter, we are not inclined to interfere with the impugned order. This writ petition fails and is accordingly dismissed.
