Vakalatnama filed by Mr.Dhruv Mathur and Mr. Akhil Kumar , learned Advocates , is taken on record.
Heard Mr. Prashant Chandra, learned Senior Advocate assisted by Mr. Shradha Agarwal, learned counsel for the petitioner, Mr. J.N.Mathur, learned Senior Advocate assisted by Mr.Dhruv Mathur, learned counsel for the opposite party no.2 and Mr.D.K.Upadhyaya, learned Chief Standing counsel.
Being aggrieved with the order dated 14.05.2010, issued by the Chairman of U.P. Water Sector Restructuring Project, the petitioner has filed the present writ petition. Mr. Prashant Chandra, learned Senior Advocate submits that the petitioner has not been communicated the result of technical bid. whereas Mr. Mathur, learned Senior Advocate informs that technical bid was opened on 27.11.2009 and the result of that very technical bid is well within the knowledge of the petitioner. Subsequently in furtherance of the bid the letter of intent has been issued to M/s Shottam Instruments private Ltd. New Delhi on 31.05.2010 and the formal agreement has been entered into between the parties on 11.06.2010.
Keeping in view the progress of the case coupled with the facts that the Contractor in whose favour bid has been finalized, is not party of the petition, we are not inclined to pass interim order. Two weeks time as prayed by Mr. Mathur, learned Senior Advocate appearing for opposite party no.2 is allowed to file counter affidavit. List on 05.07.2010, as fresh.
