The Revenue Divisional Officer, Kallakurichi, Villupuram District. ..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the Revenue Divisional Officer, Kallakurichi Division, Kallakurichi, Villupuram District, the 3rd Respondent herein to issue Community Certificates for the Petitioner's children viz., 1.S.Sanjay 2.S.Kivya as Hindu Scheduled Tribe Caste.
For Petitioner : Mr.R.Prabudoss For Respondents : Mr.M.Elumalai Government Advocate O R D E R [Order of the Court was made by M.VENUGOPAL, J.] It is brought to the notice of this Court by the Learned Government Advocate appearing for the Respondents that the Revenue Divisional Officer, Kallakurichi, in her Proceedings No.Na. Ka.A7/724/2017 dated 21.07.2017 has passed orders negativing the claim of the Petitioner for issuance of Community Certificate to the Petitioner's son S.Sanjay and Daughter S.Kivya.
2. At this stage, the Learned Counsel for the Petitioner informs this Court that he may be permitted to withdraw the present Writ Petition and to pursue the remedy before the competent forum to assail the correctness of the order dated 21.07.2017. To that effect also, the Learned Counsel for the Petitioner has made an endorsement in the Writ Petition.
3. Recording the aforesaid fact and the endorsement so made, the Petitioner is permitted to withdraw the present Writ Petition, granting liberty to the Petitioner to assail the correctness of the order of the Revenue Divisional Officer, Kallakurichi dated 21.07.2017, in the manner known to Law and in accordance with Law.
4. With the aforesaid observations, the Writ Petition is dismissed as withdrawn. No costs.
