JUDGMENT / ORDER

Petitioner is before this Court seeking police protection so far as loading and unloading work carried on in the godown of him. According to petitioner, he is doing business in steel and cement. Apart from his main business establishment, he has a godown at Kovoor, near the Kovoor Vishnu Temple. He has 4 permanent workers registered under the Kerala Headload Workers' Act and the said area is not a Scheme covered area. But still party respondents are causing disturbance to loading and unloading works at godown demanding work from petitioner.

Learned Standing Counsel representing respondent Board submits, this is not a Scheme covered area and there is no compulsion on the part of petitioner to engage the service of W.P.(C) No.14626 of 2014 2 registered workers. Even otherwise, if there is any legal right for party respondents to demand such work, which is denied by the petitioner, the recourse open to them is to approach the concerned Labour Officer, instead of taking law into their own hands and creating troubles to petitioner. Party respondents, after service of notice, remained absent.
3. In the light of above fact, we are of the opinion, there is no such legal right in favour of party respondents. Therefore, we direct the respondent-Police to afford adequate and proper protection to petitioner at the Kovoor godown of petitioner.
This writ petition is disposed of accordingly.
