JUDGMENT / ORDER

Read order dated 16/06/2014.
2. Learned counsel for the petitioner submits that she has received the order passed by the District Collector, Palakkad No.11/2014/8785/9, dated 13/06/2014. It is submitted by the learned counsel for the petitioner that the said order is not in compliance of the directions in the judgment. However, on going through the order dated 13/06/2014, it is categorically stated by the District Collector that the petitioner is entitled to use the premises for lawful purposes.
3. It is apparent from Annexure-A6 impugned order passed by the District Collector that the closure of the Ashram for use not in tune with the directions of the Hon'ble Supreme Court. The only interdiction in that order is regarding using of the building for any purposes such as rehabilitating old age women and children, which come under the Juvenile Justice (Care and Protection of Children) Act, 2000 and also under the Orphanages and other Charitable Homes (Supervision and Control) Act, 1960.

4. The petitioner has sworn an affidavit to the effect that the building will be used for lawful purposes. It is stated that the building is used as an abode for sanyasinis for performing religious and spiritual activities such as pooja, japam, dhyanam, homam, yoga and meditation according to the Sanadhana Dharma, Vedas, Sruthy, Smruthy and Vedanthas. The above affidavit is recorded.
5. It is clear from the order dated 13/06/2014 of the District Collector that the petitioner can use the building for any lawful purpose. Therefore, in view of the undertaking in the affidavit filed by the petitioner that the premises will be used only for lawful purposes, I do not see that they will have any further grievance in the matter. If the petitioner has not so far been permitted to use the building, they can approach the District Collector with a petition stating that the building will be used for the activities undertaken in the affidavit, and the District Collector shall permit the petitioner to use the building for the above purposes forthwith.
The Contempt of Court Case is, accordingly, closed.
