JUDGMENT / ORDER

The petitioner approached this Court on account of non consideration of his application for transfer of registry. He claims title based on Ext.P2. Ext.P2 is obtained pursuant to Ext.P1-Patta. 2. A counter affidavit has been filed by the first respondent, in which it is stated that the petitioner's possession and ownership of the land in question have been ascertained through the site inspection conducted by the Taluk surveyor and the village officer. However, the genuineness of the patta is yet to be verified in the back drop of entries made in the Re-survey Land Register and No.II register kept in the office of the Special Tahsildar ( LA).
3. I am of the view that any proceedings initiated to find out the genuineness of the patta shall not stand in the way of the Authority to effect transfer in registry. Ultimately, if it is W.P.(c).No.29235 of 2014 : 2 :
found that the predecessor-in-interest of the petitioner obtained patta in bogus transaction, the Authority is free to take appropriate action to evoke the patta and cancel mutation.
4. Therefore, without prejudice to the above right of the respondents, transfer of registry shall be effected forthwith.
The writ petition is disposed of as above.
