JUDGMENT / ORDER

The writ petition is with respect to a show cause notice against the Co-operative Agricultural and Rural Development Bank Limited, Trivandrum, which was granted registration long back. An amendment was made to the bye-laws with respect to the area of operation which was approved and then subsequently sought to be withdrawn. The writ petition challenged the attempt to withdraw the amendment which was already approved. Subsequent to the filing of the writ petition, it is submitted that a Division Bench had directed conduct of the election as per the amended bye-law and an elected managing committee has also come into office. In such circumstance, the writ petition is closed as infructuous, since, nothing survives in the writ petition. The legal issue whether an approved amendment can be withdrawn, is left open.
