As per Exhibit P3 agreement, the petitioner had agreed to permit respondents 1 and 2 to utilise the petitioner's property for the purpose of implementing a drinking water project. As per the agreement, the first respondent had to pay a licence fee to the petitioner. The petitioner complains that the licence fee has not been paid. 2. Advocate S.Shanavas Khan appears for respondents 1 and 2. According to the counsel, the project is to be implemented by the Kerala State Bio-Diversity Board and not by the Municipality. However, since Exhibit P5 representation is pending, the counsel assures that, the same would be considered and appropriate orders would be passed thereon.
In view of the above, this writ petition is disposed of directing the second respondent to consider Exhibit P5 W.P.(C) No.28263 of 2014-G -:2:-
representation submitted by the petitioner, in accordance with law and to pass appropriate orders thereon, after affording an opportunity of being heard to the petitioner also, as expeditiously as possible and at any rate within a period of three weeks of the date of receipt of a copy of this judgment.
