This Writ Petition is filed for issuance of a Writ of Mandamus directing the second and third respondents to survey the property of the petitioner under Survey No.15/2, under Patta No.2882, measuring 0.18.0 Ares at Mandapam Village, Ramanathapuram District and to demarcate the four boundaries, by considering the representation of the petitioner dated 14.06.2017.
2.Mr.A.Muthukaruppan, learned Additional Government Pleader takes notice for respondents. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
3.The case of the petitioner is that the property in Survey No.15/2 measuring to an extent of 0.18.0 Ares situated at Mandapam Village, Ramanathapuram District was originally owned by his father K.E.Thiyagarajan. The property was settled in favour of the petitioner by a registered settlement deed dated 16.07.2015 registered as Document No.1124 of 2015.
4.The petitioner would further state that he approached the respondents by submitting representations dated 03.11.2016, 28.03.2017 and 29.05.2017 requesting them to measuring the property. It is further stated that he paid prescribed fee. Since no action was taken, the present writ petition.
4.Mr.K.R.Laxman, learned counsel appearing for the petitioner would submit that it would suffice, if a direction is issued to the respondents 2 and 3 to consider the representation of the petitioner.
5.The learned Additional Government Pleader appearing for the respondents would submit that the representation of the petitioner will be considered in accordance with law.
6.In view of the above, this Court, without going into the merits of the matter, directs the respondents 2 and 3 to consider the representations of the petitioner, dated 03.11.2016, 28.03.2017 and 29.05.2017 and take appropriate action on merits and in accordance with law, as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.
7.With the above direction, this Writ Petition stands disposed of. No costs.
