The petitioner is the plaintiff in a suit filed before the Vacation Court (District Court), Thrissur. Along with the suit an application for temporary injunction was filed by the plaintiff. Finding that there was no urgent situation to pass interim orders in the Vacation Court, the learned District Judge passed orders to place the matter before the appropriate court (Munsiff Court, Chavakkad). Aggrieved by the said order the plaintiff has come up before this Court for a direction under Article 227 of the Constitution of India.
2. It is reported from the Vacation Court that the matter was ordered to be placed before the appropriate court when the learned District Judge found no urgency in the matter. However, it is submitted by the learned counsel for the petitioner that the plaintiff will be satisfied if the application for injunction is taken up for hearing in the Munsiff's Court immediately on re-opening. If such a course will satisfy the O.P(C) No.1121 of 2014 2 plaintiff, this original petition can be closed with such a direction.
3. In the nature of disposal, I feel it not necessary to issue notice to the other side because a direction for early hearing with notice will not cause any harm or hardship to the other side.
In the result, this petition is closed with direction to the trial court (Munsiff Court, Chavakkad) to take up for hearing, the application filed by the petitioner for temporary injunction in the suit filed by him against the respondents, immediately on re- opening, after vacation, however with notice to the other side.
