The petitioner has approached this Court apprehending recovery proceedings initiated by the first respondent- the Kerala State Housing Board. The petitioner submits that he is a farmer and is entitled for debt relief. Any relief to which the petitioner is entitled under the debt relief is unconnected to the payment of loan due to the Housing Board.
2. Therefore, with liberty to the petitioner to approach the second respondent, the relief sought in the writ petition to resist the first respondent from recovering the defaulted loan amount pending the application before the debt relief is declined.
3. It is submitted by the learned Standing Counsel for the Housing Board that One Time Settlement Scheme has been W.P.(C) No.29038 of 2014 2 floated by the Board and if the petitioner approaches the first respondent, they are prepared to consider the petitioner’s application.
Therefore, the petitioner shall approach the first respondent under the One Time Settlement Scheme within a period of two weeks. If the petitioner makes such an application under the One Time Settlement Scheme, that shall be considered within a further period of two weeks. Till then, no coercive steps shall be taken against the petitioner.
The writ petition is disposed of as above.
