THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.1757 of 2014 ORDER :
This writ petition is instituted with the apprehension that the Joint Collector-5th respondent was considering the application submitted by the Hindustan Petroleum Company Limited-
3rd respondent for grant of NOC to establish company owned and company operated retail outlet though the petitioner’s association submitted its objections on 22.01.2014 opposing grant of NOC.
2. By an order dated 30.01.2014, a direction was issued by this Court directing the District Collector, East Godavari, Kakinada to consider the objections filed by the petitioner’s association dated 22.01.2013 before considering the application of Hindustan Petroleum Company Limited dated 05.09.2013 for grant of NOC. Pursuant to the said orders, the Joint Collector passed orders on 28.03.2014 granting NOC. The said order is under challenge in W.P.No.11225 of 2014.
3. In that view of the matter, the cause in the writ petition does not survive for adjudication and it has become infructuous.
4. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
