JUDGMENT / ORDER

The first respondent issued tender notification for execution of the maintenance work of Government City Vocational Higher Secondary School at Kunnukuzhi ward in Thiruvananthapuram District. The petitioner executed an agreement with the first respondent and executed the work in question in terms of the agreement. Subsequently, the petitioner duly intimated the respondents the completion of the work and also submitted the bills. According to the petitioner, part payment was effected and for getting the balance amount, he submitted Ext.P3 representation before the respondents. This writ petition has been filed on being aggrieved by the delay in the matter of consideration of Ext.P3 representation and for effecting balance amount payable to the petitioner. When this matter is taken up for consideration, the learned counsel for the petitioner submitted that the writ petition itself can be disposed of with a direction to the respondents to consider Ext.P3 and pass appropriate orders thereon and to take appropriate follow up action for disbursement of the balance amount. Having heard the learned counsel for the petitioner and the learned standing counsel appearing for the respondents I am inclined to dispose of this writ petition with a direction to the respondents to consider Ext.P3 representation and pass appropriate orders thereon expeditiously, at any rate, within a period of one month from the date of receipt of a copy of this judgment. Subject to the outcome of the decision on Ext.P3, the amount, if any, remaining to be paid to the petitioner shall be disbursed to him expeditiously.
