The petitioners are claim to be tenants in the Commercial Shopping Complex belongs to the Aluva Municipality. The building is now being acquired for the Metro Rail Project. The 3rd respondent has already submitted a proposal for rehabilitation of the evictees before the Government. 2. The learned Special Government Pleader submitted that the proposal for rehabilitation and resettlement of evictees has been received by the Government. It is also submitted by the learned Special Government Pleader that they have received the proposal only on 13.10.2014 and the Government will be taking decision in the matter very soon, for which at least three months time is required.
3. Considering the nature and importance of the works now going on, the Government shall take early decision in this regard, at any rate, within a period of four weeks from the date of receipt of a copy of this judgment.
4. The learned counsel for the petitioners submits that 3rd respondent is proposing to construct a Shopping Complex near to the present building. It is also submitted that the 3rd respondent already have submitted a proposal before the Government for obtaining necessary sanction. The petitioners submitted that they must be accommodated in the proposed construction by the 3rd respondent Metro Rail Project.
5. I am of the view that it is for the petitioners to take up the matter before the 3rd respondent and Government. If the petitioners move such representation before the Government, the Government may take appropriate decision in the matter as expeditiously as possible. If the petitioners make request before the 3rd respondent seeking time to surrender the premises, the 3rd respondent shall consider such request to enable them to move out from the premises within a reasonable time.
The writ petition is disposed as above.
