Order:
This Writ Petition is filed feeling aggrieved by the proposed auction of the petitioners’ property bearing House No.12-8-275/1 in Plot Nos.9 and 9/1 of Survey No.805/1 situated at Alugaddabavi, Mettuguda, Secunderabad, by respondent Nos.2 to 4 on 07-10-2014.
At the hearing, Mr.Meherchand Noori, learned Counsel for respondent No.2, submitted that the aforesaid property, was also subject matter of another Writ Petition viz., W.P.No.11119 of 2014, wherein this Court vide interim order, dated 15-04- 2014, has stayed confirmation of sale to the extent of 145.67 square yards in Survey No.805/1 of Alugadda Bavi, Mettuguda, Secunderabad; that the impugned sale notification, dated 18-09-2014, was issued for different properties; that the petitioner’s property was mistakenly included therein; and that having realized the said mistake, a fresh sale notification was issued, by deleting the petitioners’ property, on 18-09-2014 itself.
The learned Counsel for respondent No.2 has also placed before the Court, a copy of the fresh sale notification, dated 18-09-2014, a perusal of which would show that the petitioners’ property referred to above has been deleted therefrom.
In the light of the above facts, the grievance of the petitioners stood redressed.
The Writ Petition is, accordingly, disposed of as infructuous.
As a sequel, WPMP.No.37627 of 2014, filed by the petitioners for interim relief, is disposed of as infructuous.
