Order:
This Writ Petition is filed for a Mandamus to declare the seizure of lorry bearing No.AP 16 TY 1118 along with rice under Panchanama, dated 18- 07-2014, as illegal and void.
By interim order granted by this Court on 23- 07-2014, the seized lorry and rice were directed to be released to the petitioners subject to certain conditions. The question whether the seizure is illegal or not is not germane for adjudication in the present Writ Petition filed during pendency of the proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short ‘the Act’). The petitioners are entitled to participate in the said proceedings, which are stated to be pending before respondent No.2, and avail further remedies, in the event, any order adverse to their interests is passed by the said respondent. In this view of the matter, I do not find any issue surviving for adjudication in this Writ Petition at this stage.
The Writ Petition is, accordingly, disposed of with the direction to respondent No.2 to complete the proceedings under Section 6-A of the Act pending before him and pass appropriate final order within three months from the date of receipt of this order.
As a sequel, interim order, dated 03-09-2014, is vacated and WPMP.Nos.25965 and 31089 of 2014 are disposed of.
