The suit is filed for partition and separate possession of ½ shares in the suit schedule property to the plaintiff.

Pending suit for partition, this Court, vide order dated 07.10.2016 in A.No.4113 of 2016, after taking into consideration the undisputed facts in the above suits, had passed a preliminary decree to the plaintiff for half share in the schedule mentioned property, which includes half share in the building.
3. Since both sides have not disputed with regard to their shares and that, there is no rival issue involved in the suit, the preliminary decree passed in A.No.4113 of 2016 is allowed to continue.
4. In the result, the suit is decreed in terms of the preliminary decree passed by this Court in A.No.4113 of 2016 vide Judgment dated 07.10.2016. However, there shall be no order as to costs.
