THE HON'BLE SRI JUSTICE L. NARASIMHA REDDY CIVIL REVISION PETITION No. 262 OF 2014 ORDER:
The petitioner filed O.S No. 366 of 2002 in the Court of IX Additional Chief Judge (Fas t Track Court) , City Civil Court, Hyderabad for partition and separate possession against the respondents. A preliminary decree is said to have been passed in the year 2006. It is stated that an appeal in C.C.C.A No. 17 of 2009 is pending in this Court.
Obviously, as there was no stay of final decree proceedings, the petitioner filed I.A No. 664 of 2006. An advocate is said to have been appointed as a Commissioner to work out the partition and that a report was submitted.
The grievance of the petitioner is that on account of delay in passing the final decree, the respondents are alienating the property. This revision is filed against the docket order dated 24- 09-2013, through which the trial Court adjourned the matter to 10- 10-2013.
Heard the learned counsel for the petitioner.
On the face of it, the revision is misconceived. It is filed against a docket order just adjourning the matter to some other date on the ground that both the parties are not ready. The petitioner is silent as to what happened in the subsequent dates of hearing.
The C.R.P is, therefore, dismissed. The miscellaneous petitions filed in this revision shall also stand disposed of. There shall be no order as to costs.
