. Respondent/Complainant Petition under section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to release the petitioners on bail in the event of their arrest in Cr. No. 91 of 2012 of Kurnool I Town Police Station, Kurnool District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri M . Achutha Reddy, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioners seek for grant of anticipatory bail. They are accused 1 to 10. They allegedly committed the offences under Sections 143, 448, 427, 341, 323, 307, 452 and 506 read with Section 34 IPC. It is the case of the prosecution that the petitioners entered the premises of the de facto complainant and damaged the property in the premises of the de facto complainant.
2. The learned counsel for the petitioner submitted that the petitioners belonged to CPI (M) and that when they had a dispute with the de facto complainant, this false case was foisted against them.
3. In view of the defence of the petitioners and also in view of the fact that no one was injured in the incident, I consider it appropriate to enlarge the petitioners on anticipatory bail.
4. Hence, this petition is allowed.
The petitioners/accused 1 to 10 shall surrender before the Judicial Magistrate of First Class, Kurnool within 2 (two) weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Kurnool shall release the petitioners/accused 1 to 10 on bail on a bond of Rs.10,000/- (Rupees ten thousand only) each with two sureties each in a like sum to his satisfaction.
