ORDER:
This Civil Revision Petition arises out of order dated 8-9-2014 in I.A.No.797 of 2014 in O.S.No.84 of 2011 on the file of the learned Additional Junior Civil Judge, at Malkajgiri.
The petitioner is the defendant in the above mentioned suit filed by the respondent. In the suit, the respondent has got Exs.A-1 and A-3 impounded by the lower Court. The petitioner filed I.A.No.797 of 2014 for rejection of Exs.A-1 and A-3 on the ground that the properties in respect of which the said documents were impounded and marked are the Government properties. This application has been dismissed by the lower Court.
I have heard Sri K. Mohan, learned Counsel for the petitioner, and perused the record.
In my opinion, the petitioner cannot seek rejection of the documents already marked as Exs.A-1 and A-3 for the simple reason that he has not questioned the order of the lower Court impounding the said documents. Having allowed the order of the lower Court to become final, it is not permissible for the petitioner to seek rejection of the said documents.
Therefore, the Civil Revision Petition is dismissed, however, with liberty to the petitioner to avail appropriate remedy, if he feels aggrieved by the impounding of Exs.A-1 and A-3.
As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.4876 of 2014 filed for interim relief is disposed of as infructuous.
