This writ petition is filed for a Mandamus declaring the action of the 3rd respondent in issuing impugned proceedings bearing No.A1/185/2014-19, dated 04-08-2014 directing the petitioner to vacate the Stall No.5 of Rythu Bazaar, Swaraz Maidan, Vijayawada, Krishna District, as illegal and arbitrary and for a consequential direction to the 3rd respondent to continue the petitioner to run the Stall No.5, Rythu Bazaar, Swaraz Maidan, Vijayawada, Krishna District.
2. When the writ petition is taken up for hearing, it is submitted by the learned counsel for the petitioner as well as learned Assistant Government Pleader for Agriculture that the subject matter of the writ petition is squarely covered by the order dated 09-04-2014, passed by this Court in W.P.No.32951 of 2013.
3. Since the issue involved in this writ petition is squarely covered by the above order, for the reasons alike in the above writ petition, this writ petition is dismissed in terms of the said order. However, till fresh allotment letters are issued to the new allottes, the petitioner shall be continued on the same terms and conditions and the petitioner shall vacate the stall as soon as new allotment letters are issued to the new allottes. No costs.
As a sequel thereto, miscellaneous petitions if any pending shall stand closed.
