Petitioner has approached this Court aggrieved by Ext. P14 revenue recovery proceedings initiated against the petitioner. Petitioner submits that revenue recovery proceedings were initiated against the petitioner pursuant to an order passed by the District Collector, Ernakulam in Ext. P4 under the Essential Commodities Act. Petitioner further submits that he has challenged the order before the District Court and the matter is now pending before the District Court as C.M.A. 91 of 2014. Pending the above proceedings, the Deputy Tahsildar, Muvattupuzha has issued Ext. P14 notice to the petitioner.
2. Considering the nature and circumstances of the case, WP(C).No.27326/14 2 the petitioner shall pay the entire amount shown in Ext.P14 without prejudice to the outcome of the CMA. He shall pay the amount covered in Ext. P14, under protest, without further delay. It is made clear that the payment to be made by the petitioner under protest pursuant to Ext. P14, shall be subject to the final outcome of the CMA.
This Writ Petition is disposed of as above.
