1. This Court (Coram: K.S. Jhaveri, J.) vide order dated 13.3.2012 has passed the following order:-
"Rule.
By way of ad-interim relief, the impugned award is stayed only qua the direction regarding continuity of service and grant of 10% back wages on condition that the respondent No.1 shall be reinstated before the next date of hearing.
Notice for confirmation of interim relief, returnable on 11.04.2012."
2. The matter was listed on 11.4.2012 and thereafter, the matter is listed today.
3. Mr.
M.H. Rathod, learned advocate for respondent No.1 workman states, on instructions, that the condition for grant of stay against 10% back wages even as per the order dated 13.3.2012 is not complied with.
4. Today the matter is called out twice, however, no one appears on behalf of the Government Pleader. The petitioner i.e. the Deputy Executive Engineer is hereby directed to remain personally present before this Court on 23.4.2012 and render explanation as to why the order dated 13.3.2012 is not complied with. If the order dated 13.3.2012 is not complied with latest by 23.4.2012, the ad-interim relief granted by the aforesaid order dated 13.3.2012 shall stand vacated. Direct service qua respondent No.1 is permitted.
