On perusal of the file, it is revealed that the appeal is pending since 1983.
As per office report, the sole appellant Dwaraka has died. A report dated 19.7.2018 has been sent by learned C.J.M., Sambhal, Chandausi. The said report is accompanied by copy of death certificate of the appellant Dwarka. In the death certificate, it is mentioned that the appellant Dwarka has died on 12.11.2013. In the report submitted by learned C.J.M., it is also mentioned that Corporator, Ward No.14, Nagar Palika Parishad, Sri Himanshu Gupta, Sonu son of deceased appellant and Trilok Chandra have given in writing that appellant Dwaraka has died on 12.11.2013. The report of C.J.M. alongwith copy of death certificate and statements of the aforesaid persons are on record.
In view of the above, the appeal is dismissed as having been abated.
