Madras High Court|13 November, 2017

JUDGMENT / ORDER

PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relation to the impugned order bearing F.m.No.000924/139/ep.gp.m/c1/2011 dated 26.02.2011 passed by the first respondent and quash the same and consequently direct the first respondent to post the petitioner as Junior Engineer in Tamil Nadu Generation and Distribution Corporation, Mela-Uluvur Section in Thanjavur District.
The learned counsel for the first respondent on instructions submits that the petitioner joined duty at Karur in terms of the impugned order of transfer and he has also made an endorsement to that effect.
2.The learned counsel for the petitioner does not dispute this factual position
3.It is trite law that an order of transfer is an incidence of service and the same is not subject to judicial review, except when it smacks of malafides or there is lack of jurisdiction of the authority passing the order, which limited grounds of interference have not been substantiated by any reliable materials in this case.
4.Accordingly, this Writ Petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
To
1.Tamil Nadu Generation and Distribution Corporation represented by its Chief Engineer (Distribution), Thiruchirappalli.
