JUDGMENT / ORDER

The present application has been preferred seeking temporary bail for a period of 30 days in connection with I-C.R. No.258/2010 registered with Dabhoda Police Station, for the offences punishable under Sections 420, 465 & 467 IPC. This application has been preferred by the applicant, through his mother, who is presently hospitalized on the ground that she is suffering from dysfunctional uterine bleeding and it was total abdominal hysterectomy under Anastassia and her surgery is scheduled on 20th July 2012.
The applicant-accused was earlier granted temporary bail by this court in Criminal Misc. Application No.7640/2012 (Coram: Mr. Justice J.C. Upadhyaya, J.) vide order dated 16/06/2012.
On hearing learned APP Shri R.C Kodekar, it appears that the applicant's mother has been admitted in the hospital and the surgery is scheduled on 20.07.2012 and none is present to look after her. The request is acceded to.
This application is partly allowed. The accused-Dushyant Bhikhabhai Amin is ordered to be released on temporary bail for a period of 10 days from 18th July 2012 on his furnishing personal bond of Rs.10,000/- (Ten Thousand Only) with one surety of like amount to the satisfaction of the jail authorities and subject to the following conditions :-
[a] He shall not take undue advantage of liberty or misuse the liberty;
[b] He shall not act in a manner injurious to the interest of the prosecution;
[c] Upon his completion of the temporary bail, the applicant shall surrender himself before the jail authorities in time.
Rule is made absolute in the above terms. Direct service permitted.
