JUDGMENT / ORDER

1. The present Criminal Misc.Application u/s.482 of the Code of Criminal Procedure has been preferred by the applicant herein – original accused to quash and set aside the complaint being C.R.No.I-241 of 2005 registered with Odhav Police Station, Ahmedabad.
2. When the present application is taken up for final hearing, at the outset, Mr.Sudhanshu Patel, learned advocate appearing on behalf of the applicant, under the instruction from his client, who is personally present in the Court, seeks permission to withdraw the present application as the applicant proposes to submit an appropriate application for discharge before the concerned Court/Magistrate.
3. In view of the above, the present application is dismissed as withdrawn with above liberty. As and when such application is made by the applicant, the same be considered in accordance with law and on merits and without in any way being influenced by the withdrawal of the present application as this Court has not expressed anything on merits in favour of the either of the parties. Rule is discharged. Ad-interim relief, if any, stands vacated forthwith.
