Heard learned counsel for the parties.
Learned Standing Counsel submits that in compliance of the order of the writ court dated 12.10.2020 the applicants have been permitted to join. However, applicants have not been paid salary so far.
Learned counsel for the applicant argues that the State being a Model Employer, it cannot take work of begaar (forced labour) from the applicants. Once they are reinstated, it is argued, are entitled to payment of salary as a consequence thereof.
Prima facie, the argument advanced by learned counsel for the applicants appears to have substance and matter requires consideration.
Let the opposite party no.1, namely, Hari Singh, Principal. Government Polytechnic, Firozabad and opposite party no.2, namely, Manoj Kumar, Director, Technical Education, U.P. at Kanpur to be present on the next date fixed and show cause as to why the applicants have not been paid salary inspite of the fact that they have been permitted to join duties in compliance of the order of the writ court and so why they may not be proceeded with under Section 12 of the Contempt of Court's Act, 1971 and be punished.
