Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed for the following reliefs:
“To issue an order or orders more particularly one in the nature of a Writ of Habeas Corpus directing the respondents to produce the detenue namely Deepika Palod, W/o. Dusakanti Praveen Goud, aged about 20 years, Occ: Housewife, R/o.H.No.12-27, Erra Satyam Colony, Nimmabaigadda, Jadcherla, Mahabubnagar District, before this Hon’ble Court forthwith and your Lordship may kindly record the statement of detenue and declaring the action of respondents is illegal, arbitrary and violation of the fundamental right to life and personal liberty under Art. 21 of the Constitution of India, and pass such other order (2) as this Hon’ble Court may deem fit and proper in the circumstances of the case.”
In the body of the petition, there has not been any allegation that the alleged detenu has been detained by the police authorities or for that matter by the private individuals and in collusion and connivance with the police. In the absence of the aforesaid allegation, we are unable to entertain this writ petition.
The writ petition is accordingly dismissed.
However, liberty is given to the petitioner to approach the appropriate forum in accordance with law, as may be advised. No costs.
