Heard learned counsel for the parties. Applicant is in jail since 11.10.2009 in connection with Case Crime No. 734 of 2009, under Section 363, 366, 376, 323 IPC.
I have perused First Information Report. It is apparent that sister of the prosecutrix had informed the family members that she has been abducted. The supplementary injury report does not shows any definite opinion about rape. Her age is about 18 years. There is no mark of injury on any part of the body of the victim.
Taking into consideration to the facts and circumstances of the case and without expressing any opinion on merits, bail application is allowed.
Let the applicant Durvijay alias Vinay son of Sri Hari Lal involved in Case Crime No. 734 of 2009, under Section 363, 366, 376, 323 IPC, Police Station Gagaha, District Gorakhpur be released on bail on executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
