Heard Sri Arun Kumar Sharma, learned counsel for the applicant and learned A.G.A. for the State.
Applicant, Durvesh Kumar @ Durvesh @ Jhapatta, has preferred this application under Section 482 of Cr.P.C. praying this Court to quash/stay the proceedings as well as the charge sheet No.427 of 2017, under Sections 323, 504, 506, 354 of I.P.c. and 3(2) (v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 7/8 of POSCO Act; Police Station Karhal, District Mainpuri.
Without going into the merits of the matter, learned counsel for the applicant states that pursuant to the summoning order, he would file his bail application on or before 12.12.2018 before the Trial Court.
The Trial Court shall consider his bail application expeditiously and till he files the same, no coercive action be taken against him pursuant to the summoning order.
However, if they do not appear before the Trial Court, the authority concerned will be at liberty to enforce the summoning order.
It is made clear that this Court has not entered into the merits of the case.
In view of the above, this application is disposed of.
