Heard learned counsel for the petitioner and the learned Standing counsel.
This petition challenges an order by which the prayer for medical re-examination has been negatived.
The entire writ petition is based on the allegation that the petitioner was not made aware of the reasons why he was declared medically unfit. However, the learned counsel for the petitioner during the course of his submissions has candidly admitted that the petitioner has put his signature on the report prepared by the Medical Board. The order impugned further evidences that the petitioner had preferred an appeal before the Regional Medical Board which too was dismissed.
Bearing in mind the aforesaid as well as the principles enunciated by the Division Bench in State of U.P. & others Vs. Rahul [2016 (3) ADJ 327], the Court finds no ground to issue the writs as prayed for.
The writ petition is dismissed.
