RESPONDENT This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to direct the respondent to dispose of the applications filed by the petitioner along with the Appeal No.80/2018-19 pending on the file of Asst. Commissioner, Shivamogga, immediately in accordance with law (Annexures ‘ B’ and ‘C’).
This Writ Petition coming on for Preliminary Hearing this day, the Court made the following:-
ORDER This writ petition is filed by the petitioner seeking writ of mandamus to the sole Respondent namely, the Assistant Commissioner, Shivamogga, to dispose of the application filed by him along with Appeal No.80/2018- 19, which is pending before him.
2. Heard the learned counsel for petitioner as well as learned AGA for respondent.
3. On going through the materials available on record, it is seen that though the appeal is filed by the petitioner herein on 14.12.2018, his application for grant of interim relief was not considered nearly for a period of 4 to 5 months. Hence, the present writ petition is filed in the month of April, 2019.
4. Learned AGA does not have any objection for this writ petition being allowed with a direction to the respondent to dispose of the application pending before him on time bound basis.
5. Accordingly, this writ petition is disposed of with a direction to the Respondent - Assistant Commissioner, Shivamogga, to consider the application for interim relief pending in Appeal No.80/2018-19 within a period of one month from the date of receipt of a copy of this order.
