Order on Criminal Misc. Correction Application No.2 of 2021.
Heard Shri Shailendra Kumar Yadav, learned counsel for the applicant on correction application dated 28.07.2021 which is moved to correct the Section 16/18 POCSO Act instead of Section 17/18 POCSO Act in the order dated 14.7.2021 passed by this Court in Criminal Misc. Bail Application No.6501 of 2021 (Durgesh v. State of U.P.).
Learned counsel for the applicant prays for and is permitted to make necessary amendments/corrections in the instant bail application.
It is alleged that due to inadvertence in the prayer clause of the instant bail application Section 17/18 POCSO Act was wrongly mentioned in place of Section 16/18 POCSO Act.
I have gone through the record.
The order dated 23.10.2020 passed by Shri Ravi Yadav, Special Judge POCSO Act I/Additional Sessions Judge-Jaunpur reveals that initially Sections 363, 366 I.P.C. and 17/18 POCSO Act, P.S. Sujanganj, District Jaunpur were mentioned in Case Crime No.157 of 2020 but on further perusal, it appears that later on Section 17/18 POCSO Act was converted into Section 16/18 POCSO Act. Due to this inadvertence, Section 17/18 POCSO Act was mentioned in place of Section 16/18 POCSO Act in the instant bail application filed before this Court and, consequently, that error occurred in the order dated 14.7.2021 passed by this Court in Criminal Misc. Bail Application No.6501 of 2021 (Durgesh v. State of U.P.).
Hence, the correction application is allowed.
"Section 17/18 POCSO Act" mentioned in 'second and fifth paragraphs' of the order dated 14.7.2021 passed by this Court in Criminal Misc. Bail Application No.6501 of 2021 (Durgesh v. State of U.P.) is corrected and be read as "Section 16/18 POCSO Act".
Computer Section is directed to make necessary corrections in this record.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by learned counsel for the applicant along with a self attested identity proof of the said persons (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked before the concerned Court/Authority/Official.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
