This application is filed by the applicant for quashing of entire proceeding initiated by Charge-sheet No.0284 of 2017, dated 18.12.2017 in S.T. No. 89 of 2017 (State Vs. Durgesh Pandey and Another) arising out of Case Crime No.564 of 2017, under Sections 323, 504, 506, 354 (ka) IPC, 7/8 POCSO Act, 3 (2)(va, 3(1)(da), 3(1) (dha) of S.C./S.T. Act, P.S. Vindhachal, District Mirzapur.
After arguing at some length, learned counsel for applicants submits that grievance of applicant would be sufficiently met in case bail application of applicant is considered expeditiously in accordance with law.
In view thereof, it is provided that if the applicants surrender before the Court below within three weeks from today and applies for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of three weeks, no coercive steps shall be taken against the applicants.
With the aforesaid, the application is disposed of.
