Heard learned counsel for the petitioner and learned Standing Counsel for the State-Respondents.
The petitioner is working as Assistant Teacher in Primary School Lisauda-2 (Khatauli), District Muzaffar Nagar since 30.9.2013. According to petitioner, her husband is physically handicapped and is bed ridden. She wants her transfer from Muzaffar Nagar to Meerut to look after her husband. Petitioner in this regard has submitted an on-line transfer application to Respondent No.6 and has also made a representation to Respondent No.5 on 11.7.2019, but her applications have not been considered by the authorities.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.7 to consider the grievance of the petitioner.
Be that as it may, considering the facts and circumstances of the case, the writ petition is disposed of with liberty to the petitioner to file a detailed fresh representation before respondent no.7, Secondary Basic Siksha Parishad, Prayagraj raising all her grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, respondent no.7 shall consider and decide the same strictly in accordance with law within a period of three months thereafter.
