Heard learned counsel for the applicant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicant, Durgesh Alias Durg Singh, in Case Crime No. 460 of 2020, under Sections- 354, 506 IPC and Section 7/8 of POCSO Act, Police Station- Achhnera, District- Agra.
Despite time granted, no counter affidavit has been filed by learned A.G.A.
There is allegation against the applicant that he has misbehaved with the minor daughter of the informant who is aged about 15 years. Counsel for the applicant has submitted that the applicant and the informant are neighbours. On account of neighbourly dispute the applicant has been falsely implicated in this case.
The applicant has already been enlarged on interim anticipatory bail by this Court by order dated 25.01.2021.
The order is confirmed.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 25.01.2021.
The anticipatory bail application is allowed to the aforementioned extent.
