Heard learned counsel for the petitioner and Shri Sanjay Kumar Singh, learned Standing Counsel.
The petitioner is before this Court for a direction to Sub Divisional Magistrate, Sadar, Mirzapur to accord licence of fair price shop in question to the petitioner in pursuance of the resolution passed by the Gaon Sabha and the recommendation dated 25.09.2018 by the Block Development Officer, Pahari, Mirzapur.
It is apprised that the said proposal has also been submitted before the Sub Divisional Magistrate and inspite of sufficient time no decision has been taken on it. In this regard the petitioner has also made detailed representation on 26.10.2018 and the same may be directed to be decided expeditiously.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the Sub Divisional Magistrate concerned to proceed in the matter and finalise the proceeding strictly in accordance with law expeditiously and preferably within three weeks from today and outcome of the said proceeding be also informed to the petitioner forthwith.
