The applicant has taken out present application seeking below mentioned relief/direction:-
"8(B) By way of interim direction, this Hon'ble Court may be pleased to direct the opponents no.4 and 5 to deposit before this Hon'ble Court the amount of pensionary benefits accrued to the applicant from the date of superannuation till date, and further pay provision/final pension to the applicant, subject to final outcome of the main Special Civil Application pending for adjudication before this Hon'ble Court, in the interest of justice.
2. The relief prayed for in present application cannot be granted at this stage inasmuch as the issue about entitlement for pension and other benefits are main issues in the writ petition being Special Civil Application No.15163 of 2010. In that view of the matter, the relief, as prayed for, in present application, cannot be granted.
3. Therefore, present application is disposed of with below mentioned directions:-
3.1 Since by order dated 3.12.2010 process of Rule was issued and made returnable on 24.12.2010 and considering the fact that the petition involves question about entitlement for pension and other benefits, office is directed to list the writ petition being Special Civil Application No.15163 of 2010 in the cause list of Final Hearing on 23.7.2012.
With the aforesaid observations and direction, present application stands disposed of.
