In Re: Civil Misc. Substitution Application No. 28437 of 2012. Heard learned counsel for the petitioner.
An application for substitution has been filed consequent upon the death of petitioner no. 2 whereby legal heirs of respondent no. 2, are sought to be impleaded as a party in place of petitioner no.2 . The grievance raised in the writ petition is for payment of graduity , therefore, cause survives. The application for substitution is allowed.
Let necessary amendments be carried out within one weeks. In Re: Writ petition Learned Standing Counsel appearing for the respondents is granted four weeks time and no more to file counter affidavit. List in the month of July, 2014.
